As you are aware, the 1 July 2019 changes are now in full swing. One change that you may not however be aware of, is the update to the Fair Work Information Statement (“Statement”). Since the introduction of the Fair Work Act 2009 (Cth) (“Act”), it is a legal requirement that employers provide all new employees with a copy of the Statement before or as soon as practical after they commence their employment. As part of the 1 July 2019 changes, the Statement was updated to reflect the changes to the national minimum wage increase and the entitlement for causal employees to receive five days unpaid family and domestic violence leave each 12 month period.
It is important that you take the time to download the new Statement by visiting the Fair Work Ombudsman’s website at https://www.fairwork.gov.au/employee-entitlements/national-employment-standards/fair-work-information-statement to ensure that all new employees are provided with the updated Statement. Failure to provide the Statement as required amounts to a contravention of the Act and penalties may apply. It is good practice that you retain details of how the Statement was given to an employee, in the event that any future issues arise regarding compliance with the Act.
